The age of optional AI policies is over. Federal guidance is tightening. More than half of the states have issued AI guidance. Student and teacher AI use is at an all-time high. But most districts still lack comprehensive policies. The question is no longer whether to address AI—it’s whether you’ll lead proactively or react under the pressure.

The Department of Education's most recent guidance on AI states that districts using federal grant funds for AI must demonstrate privacy protections, parent and teacher engagement, and responsible integration practices (U.S. Department of Education).

OUR TWO CENTS

Federal guidance is no longer a suggestion; it's setting the table for mandatory requirements in future discretionary grant competitions. Everyone else will be scrambling to backfill policy when grant language shifts. Progressive districts are getting ahead of it now.

  • Operationalize compliance before it's mandatory. Establish governance teams for AI tool vetting, mandate vendor review processes that protect student data, and invest in AI literacy training.

  • Write the paragraph now. Make sure you can confidently describe how your AI approach addresses privacy protections (specifically protecting PII from AI systems), stakeholder engagement, and responsible integration.

AI adoption in schools just hit a tipping point—and most districts aren't ready for what comes next.

Student AI use jumped to 86% this fall. Teacher use hit 85%. But comprehensive district policies are lagging far behind. The gap between what's happening in classrooms and what's governed by policy is now, in most districts, a chasm… and risks are piling up. Districts with higher AI adoption are reporting more data breaches, tech-enabled bullying (including deepfakes), AI systems that don't work as promised, and troubling student-AI interactions (CDT).

OUR TWO CENTS

Scaling without policy or guardrails creates problems. Smart districts aren’t waiting for the lawsuit or the incident that makes the news. They’re building infrastructure now—before something goes wrong—because the cost of reacting is always higher than the cost of preparing.

  • Complete inventory. Don’t assume you know what AI tools are in use—systematically document every tool, vendor, user count, data collection practice, and contract status.

  • Establish principles before procurement. Define what responsible AI looks like in your context—human-centered design, fair access, transparency, oversight, security, ethical use—before approving another vendor.

  • Engage stakeholders from day one. Gather input from teachers, parents, and students before finalizing policy, not after implementation.


This section is difficult to write, but critical to address.

In April, 16-year-old Adam Raine died by suicide. What started out as using ChatGPT-4o for homework escalated into the chatbot responding to his suicidal ideations and providing advice on techniques. The Raines are suing OpenAI, alleging the chatbot actively isolated Adam from family and friends—and didn't just fail to stop him, but helped him (NPR).

Their message on the Kara Swisher podcast (episode here — a tough listen): parents and educators must understand these tools well enough to recognize when use becomes dependency, isolation, and crisis.

Since their story became public, the FTC has opened investigations into OpenAI, Meta, and Google's student-facing AI tools (FTC). OpenAI announced it will roll out parental controls for teens (OpenAI).

OUR TWO CENTS

What happened to Adam exposes a problem that exists in every district right now. 42% of students reported using AI for mental health support. Nearly 1 in 5 have used it for romantic relationships. A third are purported to have personal conversations with AI on school devices. Yet only 11% of teachers received training on what to do when AI use crosses the line from helpful to harmful (CDT).

Most districts are facing the same gaps right now: staff who need training on recognizing concerning AI use patterns, parents who need more information about the tools their kids are using, and students engaging with AI for emotional support—often on school devices—without clear protocols in place. These aren't failures. They're the natural (and common) result of technology moving faster than policy.

  • Audit now, not after an incident. Flag every chatbot or conversational AI that allows extended, unmonitored student interactions—particularly those where students can use school devices for personal conversations.

  • Build detection capacity with counselors. Create protocols for identifying concerning student-AI dependency patterns before they escalate: students preferring AI interaction over peer interaction, emotional distress when AI access is limited, or disclosing personal problems primarily to AI tools.

  • Educate students and parents together. Teach students that they're interacting with a tool, not a person—and train parents to sit down with their kids while they use AI, ask questions, and guide them toward ethical and responsible use. Education is one of the largest user cohorts for these tools. The conversations need to start in your community.

  • Train staff on when AI undermines connection. Staff need to recognize when AI use is augmenting learning versus replacing essential human interaction—and know what to do when they see concerning patterns.
